The constant evolution of litigation, which is leading to the creation of increasingly complex and specialist legal proceedings, is making it necessary to work with teams of people that are multidisciplinary and have the technological know-how.

We have a large group of lawyers specialising in legal disputes and have created multidisciplinary work teams in the different areas of business, making use of the synergies with other practices of the firm such as M&A, Finance and Real Estate, etc. This gives our clients the assurance that the matters entrusted to us are defended bearing in mind their different legal focus, applying the best defence strategy.

We act before all courts, including the Court of Justice of the European Union and the European Court of Human Rights and the main Courts of Arbitration. Through a network of “best-friend” firms we are able to provide our clients with legal advice in the proceedings conducted before any foreign court, keeping the same contact person for all purposes.

The legal proceedings in which we have acted in the civil courts include financial and securities market claims, actions for contractual liability, disputes arising out of construction and EPC agreements, business contractual disputes, disputes arising out of agency and distribution agreements and lease agreements, the recognition and enforcement of judgments and arbitral awards delivered abroad, etc. The team also acts in proceedings relating to industrial and intellectual property.

In addition, the team regularly acts in corporate disputes before the commercial courts, in proceedings to challenge corporate resolutions, for directors’ liability and relating to shareholder agreements. Together with the Competition team our lawyers also act in actions for damages arising from infringements of competition law (follow-on actions).

Nota sobre las nuevas medidas en materia de eficiencia procesal en el ámbito del proceso civil contenidas en el Real Decreto-ley 6/2023, de 19 de diciembre

En el marco del Plan de Recuperación, Transformación y Resiliencia elaborado por el Gobierno de España para recibir apoyo financiero por parte de la Unión Europea, con fecha 20 de diciembre de 2023 se publicaba en el BOE el Real Decreto-ley 6/2023, cuyo objetivo fundamental en materia de servicio público de justicia se centra en la modernización y digitalización de la administración de justicia, así como en asegurar una mayor eficiencia procesal.

La reforma de la Ley de Enjuiciamiento Civil operada por el Real Decreto-ley 5/2023, de 28 de junio

El Real Decreto-ley 5/2023, que entrará en vigor el próximo 29 de julio de 2023, introduce una serie de modificaciones en la Ley 1/2000, de 7 de enero, de Enjuiciamiento Civil (“LEC”) y remodela, de forma sustancial, el sistema actual de recursos en materia de casación civil, contencioso-administrativo, social y penal.
